IRCC has indicated a redesigned caregiver pathway may open in the future, but no confirmed opening date has been announced. Prospective applicants should monitor IRCC announcements and should not rely on any specific date.

Caregivers assessing options now typically look at a provincial nominee program nomination or an employer-specific work permit while the federal caregiver pilots remain paused.

Caregiver Work Permits in Canada

Canadian families seeking caregivers for children or elderly parents face a bifurcated system — the TFWP caregiver LMIA route for immediate hiring, and the newer Home Care Worker streams that offer caregivers a pathway to permanent residence. Choosing the wrong route costs months.

The TFWP caregiver stream requires the Canadian employer — the family — to obtain a positive Labour Market Impact Assessment from ESDC before the caregiver can apply for a work permit. This is the employer-driven route, and the caregiver is tied to that specific household.

What most families don't realize: the LMIA process requires demonstrating that no qualified Canadian or permanent resident is available for the position. This means documented recruitment — posting the job, reviewing applications, interviewing candidates, and explaining why none were hired. Families that skip these steps or treat them as a formality risk LMIA denial.

Key Requirements for TFWP Caregiver LMIA

• Employer must advertise the position on Job Bank and at least two other platforms
• Wage must meet or exceed the prevailing wage rate for caregiver NOC in your region
• Employer must provide private, furnished accommodation (for live-in arrangements)
• Caregiver work permit is employer-specific — tied to this household
• Work permit valid for duration of LMIA, typically up to 2 years

Transition to Permanent Residence

Under the TFWP route, the caregiver must apply separately for PR after accumulating Canadian work experience — typically through CEC (if experience is TEER 0/1) or through a PNP. There is no automatic PR pathway attached to the LMIA work permit itself. The Home Care Worker Immigration Pilots offered a more direct PR pathway when open, but IRCC paused new intake under those pilots in December 2025.

The Home Child Care Provider (HCCP) pilot allowed caregivers to apply directly for a work permit with a built-in pathway to permanent residence, without the employer obtaining an LMIA first. HCCP closed to new applications on June 17, 2024, along with the Home Support Worker (HSW) pilot.

HCCP and HSW were replaced by the Home Care Worker Immigration Pilots (HCWIP), which opened March 31, 2025. Only the Workers in Canada stream opened, and it filled its intake cap within hours. In December 2025, IRCC paused new intake under the Home Care Worker Immigration Pilots until further notice and confirmed the pilots would not reopen as previously anticipated.

IRCC has referenced a March 31, 2027 opening for the stream covering applicants outside Canada, but this reference predates the December 2025 intake pause, and IRCC has stated the pilots will not reopen as previously anticipated. In practice, announced caregiver dates have shifted repeatedly since 2024, and IRCC's own guidance is not to rely on any specific timeline. If you are planning a caregiver pathway, treat the 2027 reference as tentative, prepare your documents so you are ready if an intake opens, and in the meantime assess currently available alternatives rather than waiting on an unconfirmed date.

The structure below reflects how HCCP worked while it was open. It is retained for reference and does not describe a pathway currently accepting new applicants.

Eligibility Requirements (While HCCP Was Open)

• Language: CLB 5 in all four abilities (speaking, listening, reading, writing)
• Education: Post-secondary credential of at least one year (Canadian or equivalent)
• Job offer: Valid offer of employment for an in-home child care position
• Occupation: NOC 44100 (Home Child Care Providers) or NOC 44101
• No criminal inadmissibility; medical clearance required

Stage 1 Work Permit

The Stage 1 work permit was employer-specific but marked the application for PR pathway eligibility. The work permit was typically issued for the duration of the employment offer, up to 4 years. Caregivers could change employers during Stage 1 if they obtained a new employer-specific work permit; switching employers did not reset the clock on experience accumulation.

Stage 2 PR Application

After accumulating 24 months of full-time equivalent experience in the eligible occupation, the caregiver submitted a Stage 2 application. IRCC issued an open work permit while the PR application was processed, so caregivers were not left in limbo while waiting for a decision.

The table below compares the TFWP LMIA route, which remains open, with the HCCP/HSW structure that preceded the now-paused Home Care Worker Immigration Pilots. It is retained for reference. Only the TFWP LMIA route is currently accepting new applications.

Choose TFWP LMIA if:

• The caregiver lacks post-secondary education
• CLB 5 language requirement cannot be met
• The employer wants to sponsor a specific individual
• Caregiver already has Canadian experience for CEC

HCCP/HSW Suited You If (Pathway Now Paused):

• Caregiver meets CLB 5 and post-secondary requirements
• PR is the goal, not just a work permit
• Family cannot afford or manage LMIA process
• Caregiver wants control over their own pathway

Caregiver applications fail for specific, recurring reasons, most of which are documentation problems, not eligibility problems. The person was eligible; the file didn't prove it. The HCCP/HSW-specific reasons below apply to applications already submitted under those closed pilots or under the paused Home Care Worker Immigration Pilots. The LMIA-specific reasons apply to the TFWP route, which remains open.

Inadequate LMIA Recruitment Records

ESDC reviewers verify that recruitment was genuine. Families who post jobs with unrealistic requirements (5 years experience, advanced credentials) signal fraudulent recruitment. Ads must reflect the actual position and wages offered.

Credential Document Gaps (HCCP/HSW)

IRCC requires the post-secondary credential to be assessed against Canadian equivalency if it's from outside Canada. Caregivers who submit foreign diplomas without an ECA from a designated body face refusal or significant processing delays.

Relationship Genuineness Concerns

Officers assess whether the employment relationship is genuine — especially for caregiver applications where the employer and worker are relatives or friends from the same country of origin. Prepare documentation that demonstrates the legitimate care need: medical records, children's ages, household composition, and the caregiver's relevant qualifications.

Stage 2 NOC Mismatch

The biggest hidden trap in Stage 2 PR applications is submitting employment records that don't align with the eligible NOC duties. Reference letters must describe specific caregiver tasks — not just confirm employment dates. Generic reference letters from employers result in Stage 2 requests for additional evidence and 6-12 month delays.

Agency Employment During Stage 1

Caregivers placed through staffing agencies during their Stage 1 work permit period may discover this experience does not count toward the 24-month PR threshold. The employment must be with a private household, not through an intermediary organization.

Expired Language Test Results

IELTS and CELPIP test results are valid for 2 years. Caregivers who tested years before applying under HCCP/HSW must retest if results have expired — even if they completed the tests originally for another purpose.

When the LMIA Route Is Faster

The TFWP LMIA route can be faster for families that need a caregiver immediately. LMIA processing averages 10-13 weeks for caregiver applications, which was faster than the typical HCCP Stage 1 processing time when that pilot was open. If the caregiver plans to transition to CEC later, starting with an LMIA-based work permit loses no ground. With the Home Care Worker Immigration Pilots currently paused, the TFWP LMIA route is the only currently available option for families that need to bring in a caregiver now.

If the HCWIP Pathway Reopens

Caregivers who meet the CLB 5 and education thresholds would be better served by a caregiver-specific PR pilot, because it removes employer dependency for the PR application, if and when the Home Care Worker Immigration Pilots reopen. Under the TFWP route, the employer can withdraw support, move provinces, or decide not to assist with PR, leaving the caregiver to navigate CEC or PNP independently. Since IRCC has not confirmed a reopening date, caregivers should not delay pursuing a currently available pathway while waiting for the pilots to resume.

Employer Obligations Under Each Stream

• TFWP LMIA: Employer is responsible for wages, accommodations (if live-in), and compliance with the LMIA conditions. ESDC inspections can occur.
• HCCP/HSW: No formal employer registration with ESDC required, but employer must provide genuine employment and valid offer letter for Stage 1.
• Both streams: Employer cannot deduct LMIA or processing costs from the caregiver's wages — this is a violation of employment standards and an inadmissibility risk for the employer.

Consider Alternatives If...

• The care need is temporary (under 1 year) — explore visitor visa options for short-term family visits
• The caregiver is a close relative of a Canadian PR or citizen — consider family sponsorship as a parallel pathway
• The caregiver has significant Canadian education — CEC or PGWP route may be faster than caregiver-specific streams
• The care need is institutional (not in-home) — non-caregiver NOCs may apply and different pathways become available
